OnGuard defines "Personal Data" as any information necessary to verify the identity of the individual which includes but not limited to: full name, address, city/town, zip, phone and fax numbers. By registering to use the Service, you agree (1) to comply with the terms and conditions of this Privacy Policy.
Personal Data
We will not sell or market the email addresses or other collected personal information of registered Users to third parties nor does OnGuard view the files that you backup.
From time to time OnGuard occasionally send you email communications regarding your account and you agree to accept them and not deem them as spam. You can choose to be removed from our email list by emailing us directly.
When your register your software, your information given which may include company name, phone number, city, state, country, zip code, a user name, confirmed email address, and a password. When backing data up, you send us that data and file system information, including names of files and directories and well as your IP address All information collected is for internal purposes to provide our Fanatical Service and support. To protect your account, please treat your passwords as you would any confidential data.
OnGuard does not disclose Personal Data to third parties, except to process credit card information.
Law Enforcement requests
OnGuard will disclose your Personal Data, including the data you back up, with or without notice and consent: if subpoenaed by law enforcement agencies or other judicial or administrative order, or where required by law or at our sole discretion, where it may be necessary to protect OnGuard employees, individuals or the general public – determined by OnGuard.
Security Compliance
OnGuard uses industry standard security measures to protect against the loss, misuse and alteration of the data in our facility. We make good faith efforts to store the information in a secure operating environment using access control and video monitoring measures and no access with the general public however OnGuard cannot guarantee 100% security. While we take proper and responsible steps to ensure the security of our network and systems, we cannot guarantee or prevent third-party "crackers" from obtaining this information.
If you cancel your account, your data will be immediately deleted from our servers and your account information archived.

ACCOUNT PASSWORDS AND SECURITY
You are responsible for securing your passwords. OnGuard accepts no liability for lost, stolen passwords, encryption keys or any activity that occurs as any result of password/encryption problems. If you lose your encryption key you will not have access to your store data which in maintaining a secure environment is beyond OnGuards control.
OnGuard, its employees & affiliates are to be held harmless in any and all cases where your data is compromised. OnGuard its affiliates and employees are to be held harmless in the event of data loss, business as a result of data loss and any and all illegal activity associated with such data. OnGuard reserves the right to suspend/terminate an account for any and all reasons, determined soley by OnGuard, if its felt our best interests are in jeopardy. In the event of account cancellation/termination, all data residing on our servers will be immediately deleted.
CHANGES TO THE SERVICE & TERMS & CONDITIONS
OnGuard reserves the right at any time to modify, suspend, or discontinue providing the Service or any part thereof in its sole discretion with or without notice. OnGuard will contact you to the best of our ability using email, fax, phone - however we are not liable for client non – responsiveness. Onguard can modify any and all areas of this agreement at its discretion and you agree ot be liable for all such modifications.
TERM AND TERMINATION
This Agreement is effective upon signing up for the OnGuard services and remains in effect until the users' account is terminated. You may terminate this Agreement at any time by uninstalling the software and issuing OnGuard a cancellation of service – at such time, any and all invoices are payable and due. Upon termination your data will be deleted form our servers and made inaccessible to you.
DISCLAIMER OF WARRANTIES
THE SOFTWARE AND SERVICE AND ANY THIRD PARTY SOFTWARE AND SERVICES ARE PROVIDED "AS IS," WITH NO WARRANTIES WHATSOEVER. OnGuard IS NOT RESPONSIBLE FOR DOWNED INTERNET SERVICE, SOFTWARE ERRORS OR VIABILITY OF DATA.
LIMITATION OF LIABILITY
UNDER NO CIRCUMSTANCES SHALL ONGUARD, OR ITS SUPPLIERS, RESELLERS, PARTNERS OR AFFILIATES AND REASELLERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SOFTWARE OR SERVICE.
